An example from our practice:
- 25.03.2025 - State inspector of MTU Rostransnadzor for the Central Federal District found the individual entrepreneur guilty under Part 2 of Art. 12.21.1 of the Administrative Code of the Russian Federation and imposed a fine of 375,000 rubles.
- 21.02.2025 - The driver of Kamaz as part of a five-axle road train violated traffic rules: excess of the load on the axles by 3-10% (measurement error of 10%).
The individual entrepreneur did not agree:
- the shipper's scales are more accurate;
- other frameworks did not record a violation;
- Normative legal acts do not contain formulas for calculating the load on axes.
The average axle load, as calculated by the applicant, was 7,455 kg with a permissible 10 tonnes.
Labyrinths of the judicial system
The individual entrepreneur filed a complaint with the Moscow Arbitration Court. The court decided that at the time of the violation he did not carry out entrepreneurial activity, and referred the case to the court of general jurisdiction of the city of Moscow. After several months, the case was redirected to the Kemerovo region.
During this time, the entrepreneur had the opportunity to:
- appeal the decision to a higher authority;
- apply to the district court at the place of consideration of the case;
- Protect your rights through arbitration courts.
Today, ten months after bringing to administrative responsibility, there is no procedural decision in the case. The individual entrepreneur went through all stages: from denial to acceptance.
